1. General Practices and Limits

You acknowledge that PartyUpGG Ltd may establish general practices and limits concerning the use of the Services, including the maximum time that data or other content will be retained, and the maximum storage space available on PartyUpGG Ltd’s servers or its third-party service providers’ servers. You agree that PartyUpGG Ltd has no responsibility or liability for the deletion or failure to store any data or content maintained or uploaded by the Services. PartyUpGG Ltd reserves the right to terminate Accounts that are inactive for an extended period of time and to modify these practices at any time without notice.

2. Who May Use the Services?

You may only use the Services if (i) you are 18 years of age or older (or the legal age of majority in your jurisdiction) or are between 13 and 17 years old with the consent of a parent or legal guardian; (ii) you are capable of entering into a binding contract with PartyUpGG Ltd; and (iii) you are not prohibited from using the Services under applicable law.

3. Rights in Content Granted by PartyUpGG Ltd

Subject to your compliance with these Terms, PartyUpGG Ltd grants you a limited, non-exclusive, non-transferable, and revocable license to download, view, copy, display, and print the content solely for personal, non-commercial use and in connection with your use of the Services.

4. Third-Party Content

PartyUpGG Ltd is not responsible for third-party content or materials, including user-generated content, and makes no warranties regarding such content. Any use of third-party content is at your own risk.

5. Prohibited Uses

You agree not to use the Services or any content accessible through the Services for any commercial purpose, including but not limited to competing with PartyUpGG Ltd’s services, or for any unlawful or harmful activity.

You will not create or compile any collection or directory of the content for any purpose other than personal, non-commercial use.

You will keep your account credentials secure and confidential and will not share them with others.

6. Payments and Payment Services

When using the Services, you may make Purchases via third-party payment processors, including but not limited to debit card, credit card, or other payment methods. PartyUpGG Ltd uses third-party services, such as Stripe, to process payments. By making a Purchase, you authorize the payment processor to charge your Payment Method for the agreed-upon amounts.

7. Copyright Policy

Under the Copyright, Designs and Patents Act 1988, if you believe that any content infringes your copyright, you may submit a notice requesting its removal in accordance with our policy.

8. Disclaimers

he Services are provided “as is” without warranties of any kind, either express or implied. PartyUpGG Ltd does not guarantee that the Services will be error-free, uninterrupted, or meet your requirements. We disclaim liability for any indirect, incidental, or consequential damages, including but not limited to loss of profits, data, or business opportunities.

9. Indemnity

You agree to indemnify and hold PartyUpGG Ltd and its affiliates, officers, directors, employees, and agents harmless from any claims, losses, liabilities, or expenses (including legal fees) arising from your use of the Services or any violation of these Terms.

10. Limitation of Liability

To the fullest extent permitted by law, PartyUpGG Ltd will not be liable for any indirect, incidental, special, or consequential damages arising from your use or inability to use the Services, even if advised of the possibility of such damages. In no event will PartyUpGG Ltd's total liability exceed the amount you paid for the Services in the 12 months preceding the claim.

11. Jurisdiction and Governing Law

These Terms are governed by and construed in accordance with the laws of the United Kingdom. Any disputes relating to these Terms will be subject to the exclusive jurisdiction of the courts of the United Kingdom.

12. User Disputes

You agree that you are solely responsible for your interactions with other users of the Services. PartyUpGG Ltd has no obligation to become involved in disputes between users but reserves the right to do so at its discretion.

13. Links to Third-Party Websites

The Services may contain links to third-party websites or resources. We are not responsible for the content, products, or services on those websites. You use these links at your own risk.

14. Communications

You consent to receive communications from PartyUpGG Ltd via email, SMS, or telephone, including any automated communications. You may opt-out of communications as permitted by applicable law.

15. Modifications to the Terms

PartyUpGG Ltd reserves the right to update or modify these Terms at any time. Changes will be posted on the Services, and you are responsible for reviewing the updated Terms. Continued use of the Services constitutes your acceptance of the revised Terms.

16. Teammate player rankings

Matching with a teammate for Fortnite is based on Fortnitetracker "PR" 1k+ PR will be referred to as "unreal ranked player" - 1.5k+ PR will be referred to as "top 1% unreal ranked player" - 2k+ PR will be referred to as "top 0.1% unreal ranked player"
